SHRR 46-050. Review of Disputed Administrative Closures (1) The Committee Chair will review disputed administrative closures issued by the Office pursuant to SHRR 40310. (2) In order to challenge an administrative closure the Charging Party must file a written statement challenging the administrative closure with the Commission within 30 days after the Department sent its notice closing the case. Civil Rule 6 "Time" applies to this rule. The Charging Party's statement shall state specifically why the Office was in error in closing the case. (3) The Committee Chair will review the disputed administrative closure within five days of when the Charging Party's challenge is received, except in extraordinary circumstances. (4) The Committee Chair's review will consist of evaluating the Offices reasons for administrative closure and the Charging Party's reasons for challenging the Department's decision to close along with such further action as the Commission may deem to be necessary. |
